Section 24D1A
Promotion by seniority and performance appraisal

(1) Notwithstanding anything contained elsewhere in this Act, the promotion committee, when recommending for promotion based on seniority and performance evaluation, shall recommend promotion to the candidate with the longest service period in the post one category below the post to be promoted on the following basis:-
(a) having obtained ninety-five per cent or more marks in the performance evaluation average for the last year, as required by the number of years of service required to be a potential candidate for promotion,
(b) For gazetted first class posts at least S.L.C. or having equivalent educational qualification,
(1) At least Bachelor's degree or equivalent in the subject related to the relevant service, group or sub-group for the post of Gazetted Second Class or above and at least Certificate level or equivalent in the subject related to the relevant service, group or sub-group for the post of Gazetted Third Class Having,
(2) If there is no potential candidate who has received full-time training for one month or more in a subject related to the service, group or subgroup in a position below the position to be promoted, but has received full marks due to working in the geographical area, or if there is a situation where potential candidates are not available for the allocated vacant position. Employees who do not get full marks due to working in such a position in the geographical area will also be promoted as potential candidates.
(2) Notwithstanding anything written in sub-section (1), the promotion committee, when recommending for promotion on the basis of seniority and performance evaluation as per clause (d) of sub-section (1) of section 7, shall recommend promotion on the following basis –
(a) obtained ninety-five percent or more marks in the average of last three years of performance evaluation,
(b) having attained the minimum educational qualification prescribed for the Gazetted Second Class of the concerned service, group or sub-group, and
(c) Candidates belonging to non-ranked posts or gazetted fifth category posts to non-ranked posts.The longest service period among the candidates who have completed at least twenty years of service including the service period.
(3) If a potential candidate under the restrictive clause of clause (c) of sub-section (3) of sub-section (1) is promoted, the seniority of such employee shall be maintained in such a way that it will be later than other employees who will be promoted in accordance with the same sub-section.
(4) When promoting according to this Act, after completing the promotion procedure according to this section and recommending it, the promotion should be recommended based on performance evaluation. 24h1b Provisions related to the adjustment of employees promoted by evaluation of performance and experience:- (1) Before the commencement of this section, the ministry operating a service, group or sub-group for the adjustment of employees promoted by evaluation of performance and experience shall, within one month from the date of commencement of this section, the relevant ministry, secretariat or The commission will create a bridge post and adjust the posts to the employees who have been promoted and will be in such post.
(2) Before the commencement of this section, the service, group or for the adjustment of the employees who have been called for promotion by evaluation of performance and experience and who are yet to receive promotion appointment and who have been invited for promotion by evaluation of performance and experience within one year from the date of commencement of this section. The ministry conducting the sub-group will create a bridge portal in the relevant ministry, secretariat or commission and assign the employees who have been promoted and will be adjusted in such portal.
(3) Notwithstanding anything written in sub-sections (1) and (2), if the employees who have been promoted and are to be employed in an agency that does not have a civil service quota, a bridge quota should be created in the agency where such employees have quota, and adjustments should be made to such quota.
(4) According to sub-sections (1), (2) and (3) after adjustment posts are made, the posts held before promotion will automatically be cancelled.
(5) Adjustment according to sub-sections (1), (2) and (3).Within two months of the appointment, the relevant ministry, secretariat or commission shall review the organization structure and recruitment of the previous employee and send it to the Ministry of General Administration for approval by evaluating the performance and experience of the promoted and future employees. In the statement sent in this way, the salary of the former employee, the employee who has been promoted based on performance and experience evaluation, and the salary that can be adjusted through restructuring should be sent.
(6) After receiving the details as per sub-section (5), the Ministry of General Administration will analyze and approve the customs clearance within one month.
(7) After the customs clearance is approved according to sub-section (6), the revised customs clearance details should be updated from the civil library.
(8) According to sub-section (7) after the Darwandi details are updated from the civil library, the ministry that operates services, groups and sub-groups in the Darwandi approved according to sub-section (6) shall determine the priority order of the interests and desires of the employees who are in the upper qualification order from the merit list prepared according to sub-section (9) will be appointed.
(9) For the purpose of sub-section (8), the ministry operating the service, group or sub-group shall prepare and keep a merit list of the employees who have been promoted by evaluating the performance and experience of the relevant service, group or sub-group. In this way, while preparing the merit list, it should be prepared on the following basis:-
(a) On the basis of the date of application of seniority to the post in the category currently held,
(b) If there is no separation of seniority in accordance with clause (a), on the basis of the date of appointment or promotion to a position below one category,
(c) in the order of merit recommended by the Public Service Commission or the Promotion Committee for a post below one grade if seniority is not distinguished from the basis mentioned in clauses (a) and (b),
(d) On the basis of age seniority if there is no separation of seniority according to clauses (a), (b) and (c).
(10) After being appointed in accordance with sub-section (8), such bridge gatekeeper shall automatically bWill be angry.
(11) Notwithstanding anything written elsewhere in this Act, the employees in the bridge guard under sub-sections (1), (2) and (3) shall not be transferred elsewhere without being posted as per sub-section (8).
(12) Notwithstanding anything written elsewhere in this Act, no employee shall be transferred or assigned to work in an office appointed in accordance with sub-section (8) without completing the period specified in sub-section (3) of section 18. However, employees who have received additional financial assistance from the Government of Nepal, who have been recommended as sick by the medical ward constituted by the Government of Nepal, who have received certificates of "A" and "B" categories of disability, who want to be posted in remote areas including local bodies, employees who are suffering from serious diseases, spouses or Employees who are living in an accessible place after their wife is treated for serious illness, employees with special circumstances, women who are pregnant, women who are unable to go elsewhere due to family reasons, employees who are two years or less before retirement can be transferred to the vacant position according to this section with the consent of the Ministry of General Administration. There will be no hindrance to do or work.
(13) Notwithstanding anything written elsewhere in this section, the adjustment of posts made in accordance with this section shall not have any adverse effect on the arrangement for filling up posts in accordance with sub-section (1) of section 7, except for the posts created under this section.
